These Terms & Conditions ("Terms") govern your use of klientssgrowths.com (the "Site") and any related services we provide ("Services"), operated by KlientssGrowth, run by Harsh Shah, based in Navsari, Gujarat, India ("we", "us", "our"). By using the Site or booking a call with us, you agree to these Terms. If you don't agree, please don't use the Site.
1. What we do
KlientssGrowth provides marketing services to local businesses, including:
- Smart website design and development
- AI receptionist / chat-widget installation
- Paid advertising management (Google Ads, Meta Ads)
- Search engine optimization (SEO) for local search
- Online reputation and review management
The Site is informational. Booking a call does not create an engagement. A formal engagement begins only when both parties sign a separate written agreement (or its email-confirmed equivalent) and any required payment is made.
2. Booking a discovery call
You can book a free 30-minute discovery call through our Cal.com integration. Booking is offered subject to availability and at our discretion. We may decline or reschedule any booking, particularly if it appears to be spam, made in bad faith, or outside our service scope.
The discovery call is exploratory. We do not commit to delivering Services until a separate agreement is signed.
3. No guarantee of results
Marketing results depend heavily on your business, your market, your offer, your service quality, your willingness to take action, and many factors outside our control. While we share past results from previous clients in good faith, those results are not a promise or guarantee that you will achieve the same outcomes. Past performance does not guarantee future performance.
Specifically, the case studies and figures referenced on this Site (including the "13 booked jobs in 14 days" Orlando plumbing case) describe specific past engagements under specific conditions and are illustrative, not predictive.
4. Acceptable use
When using the Site, you agree not to:
- Use the Site for any unlawful purpose
- Attempt to bypass any security or access controls
- Scrape or harvest data from the Site without our written permission
- Submit information you don't have the right to share, or use a fake identity
- Send spam or use automated bots to book calls
- Disrupt, damage, or attempt to overload the Site or its hosting infrastructure
We may suspend or terminate your access to the Site at any time, with or without notice, for any breach of these Terms.
5. Intellectual property
All content on the Site — including copy, design, code, graphics, animations, and case-study materials — is owned by KlientssGrowth or used with permission. You may not copy, modify, redistribute, or reuse this content commercially without our written consent.
You retain ownership of any content you provide to us (e.g. on a booking form). By providing it, you grant us a limited license to use it solely for the purpose of providing the Services to you.
6. Third-party links and embeds
The Site embeds and links to third-party services (Cal.com, GoHighLevel, Google, Meta, etc.) and may link to other third-party websites. We don't control those services and aren't responsible for their content, terms, or privacy practices. Use them at your own risk.
7. Disclaimer of warranties
The Site and any free informational materials are provided "as is" and "as available", without warranties of any kind, either express or implied. We don't warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components.
8. Limitation of liability
To the maximum extent permitted by law, KlientssGrowth, Harsh Shah, our employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost revenue, lost data, or lost goodwill — arising from your use of the Site or any free informational materials, even if we've been advised of the possibility of such damages.
Where liability cannot be excluded as a matter of law, our total liability arising out of or relating to the Site (excluding paid Services governed by a separate agreement) is limited to USD 100.
9. Indemnification
You agree to defend, indemnify, and hold harmless KlientssGrowth and Harsh Shah from any claim, demand, loss, or damages (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any applicable law or third-party right.
10. Changes to these Terms
We may update these Terms at any time. The "Last updated" date at the top tells you when the latest version took effect. Continued use of the Site after a change means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of India, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be resolved in the courts of Navsari, Gujarat, India, unless otherwise required by mandatory consumer protection laws of your country of residence.
12. Severability
If any part of these Terms is found unenforceable, the rest remains in effect.
